Rental Inquiry

Can I back out of renting a place even if I just put down a damage deposit?

Yes you can. This happened to me a few years ago. I gave my damage deposit on a aprtment abut did not sign a lease, I had to back out and they were fine with it and gave me back my deposit.

Depends on the person that you would have been renting from. They may or may not give you back the deposit. Hopefully it wasn't a large amount.

When you put a deposit down, you're making a commitment. It really depends on the landlord to the new building you would have been moving to. They could have missed out on interest from someone. You really should call the person you left the deposit with.

I'm pretty sure they can't keep your damage deposit. If you didn't move in what grounds would they have for keeping it?

Someone else could have possibly rented it. It puts the owner out a months rent, and so that would be the reason for keeping the damage.
And if the rental agreement was month to month, then there would be no signed papers.

This exact situation happened to my mother. She was suppose to move into a place and they kept putting the date of her move in off so she finally got tired of waiting and found another place. She put down a $350 deposit and they would not return her money. She called the rentalsman and they did nothing. Personally in my mother's situation I think it was BS. She was willing to move in but because of circumstances within the landlords control she didn't take it. She should have gotten her money back. I believe it was Scottish Enterprises, (it was on Sussex Drive) so if that is who you are dealing with, GOOD LUCK!

Thanks for all the responses. I've been told that I am in fact locked by giving the landlord the damage deposit. I was also told that the only way I would be given the damage deposit is the unit gets rented by Oct. 1st. I highly doubt that being that they have now found me as a tenant, I highly doubt that the property manager will look for another possible tenant.
